The requirement for a .com.au to refer to an Australian company appears not to have been enforced for some years.
There are alternate rules, you don't have to be a company per se, but you do need to have a product or service as an alternative "reason" to have said domain name. There are plenty of temporary .com.au domain names that are used for competition and/or other marketing purposes that wouldn't fit the ordinary "name" rules. Still, .com.au are meant to be entirely for "commercial purposes".
