2.3 is typically offered on phones around the $100 mark, so the answer is probably cost. Some offer updates to 4.0 (eg. Huawei Ascend G300+). I would suggest going to the place of purchase and asking for help. If they can't help you, that's probably enough cause to be entitled to a refund.
