And it looks like they, through the Illumos community, will end up forking OpenSolaris (incl. ZFS and other solaris goodies) by default if Oracle doesn't start actively participating.
I was talking to the local FreeBSD people two nights ago, and they say this basically has already happened. The OpenIndiana/Illumos codebase is already merging patches and has become the de-facto head version without Oracle's participation.
